Terms of Service

1. Agreement

By creating an account or using the Service, you agree to these Terms and our Privacy Policy, Acceptable Use Policy, and Copyright Policy. If you use the Service for an organization, you represent that you have authority to bind it.

You must be at least 13 years old. If local law requires a higher age or parental consent for you to use the Service, that requirement also applies.

2. Accounts and organizations

Provide accurate account information and protect your passwords, passkeys, recovery methods, access tokens, SSH keys, device authorizations, agents, and API credentials. Tell us promptly if you suspect unauthorized use.

Organization owners control memberships, roles, repositories, integrations, and billing for their organization. You are responsible for activity performed through credentials and integrations you authorize, except to the extent caused by GitCafe's breach of these Terms or applicable law.

3. The Service and beta features

We may add, change, limit, or discontinue features. Beta, preview, and experimental features may be incomplete, may change without notice, and have no service-level commitment. Roadmaps describe current direction, not promised delivery dates.

Private repositories are free during the current beta. We will publish pricing and give reasonable advance notice before changing that arrangement.

4. Your content and ownership

You retain ownership of code, repositories, issues, pull requests, comments, attachments, release assets, CI configuration and logs, and other content you submit. You represent that you have the rights needed to submit and use that content through the Service.

You grant GitCafe a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, index, back up, and technically modify your content only as needed to operate, secure, maintain, and provide the Service, comply with law, and provide features you enable. We do not use repository content to train generative AI models.

5. Public and private repositories

Marking a repository public directs us to make it available on the public internet and enables others to view, clone, and fork it. Public availability alone does not grant intellectual-property rights beyond Service functionality; the repository's license and applicable law govern broader use.

We treat private repository content as confidential and use reasonable safeguards against unauthorized access. Access is limited to operating and securing the Service, automated security and abuse controls, support requested by an authorized owner, incident or policy investigations, approved service providers, and legal obligations.

6. APIs, automation, and integrations

You may use documented APIs and first-party tools subject to published technical limits. Do not evade rate limits, probe credentials, scrape private information, or impair the Service.

Applications, agents, workflows, webhooks, and integrations may execute code or transmit data. You are responsible for reviewing the permissions and third-party terms of services you enable. GitCafe is not responsible for third-party services.

7. Security features and backups

Secret scanning, signature verification, rulesets, status checks, and other security features reduce risk but cannot detect every issue. You remain responsible for reviewing code, protecting credentials, configuring access, responding to exposed secrets, and keeping independent copies of important repositories and artifacts. Platform backups support service recovery and are not a substitute for your own backups.

8. Paid plans

Paid plans renew for the interval shown at checkout until canceled. You authorize applicable charges, taxes, and disclosed seat or usage charges. Cancellation takes effect at the end of the current paid period unless stated otherwise. Fees are non-refundable except where law requires, and we will disclose material price changes before the affected renewal.

After downgrade, expiration, or nonpayment, we may restrict paid features or writes after reasonable notice. We will not make a private repository public solely because a subscription ends.

9. Suspension and termination

You may stop using the Service and close your account subject to organization ownership and billing obligations. We may restrict or terminate access for material or repeated violations, legal requirements, security threats, nonpayment, or material harm. Where practicable, we will provide notice, an opportunity to cure or appeal, and a reasonable opportunity to export content. Some attribution, audit, backup, fraud-prevention, and legally preserved records may remain after account closure as described in our Privacy Policy.

10. Disclaimers and liability

To the extent permitted by law, the Service is provided “as is” and “as available,” without warranties of uninterrupted, error-free, or completely secure operation. Nothing in these Terms excludes rights that cannot lawfully be excluded.

To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, goodwill, or data. GitCafe's aggregate liability arising from the Service will not exceed the greater of $100 or the amount you paid GitCafe during the 12 months before the claim. These limits do not apply where prohibited by law.

11. Law, trade controls, and changes

You may not use or provide the Service in violation of applicable export-control or sanctions laws. We may restrict access where required to comply with those laws.

We will announce material changes by email or prominent in-product notice before they take effect. These Terms, together with incorporated policies and any applicable order form, are the entire agreement concerning the Service. Contact legal@git.cafe with legal questions or notices.
